Multiple DUI Court
The Multiple DUI Court Program aims to improve traffic safety by providing intensive supervision of multiple DUI offenders while connecting them with the community and recovery resources they need to address their driving habits and their alcohol use. The Multiple DUI Court Program utilizes a multidisciplinary team approach combined with intensive supervision to identify and treat the root causes of criminal behavior.
The Program
The program operates as an exclusively post-plea court. Defendants charged with a 2nd or 3rd DUI offense within 10 years except those subject to disqualification criteria are screened for eligibility. The program is designed to be 6 months of intensive supervision but may be reduced to 4 months or lengthened dependent on a participant’s compliance. Components of the program include:
- Regular court appearances
- Random drug and alcohol testing
- Regular probation visits
- Enrollment in the Multiple Offender Program at a DMV approved provider
- Installation of an Ignition Interlock Device in a vehicle
- Substance use treatment and/or other supportive programming
Eligibility
A defendant charged with a 2nd or 3rd DUI offense is eligible to participate in the Multiple DUI Court Program if:
- They are a resident of San Mateo County, Alameda County, Santa Clara County, or San Francisco County
- They have not been ordered to serve more than 30 days on a 2nd DUI offense or more than 180 on a 3rd
- They have not been ordered to serve more than 90 days residential treatment on a 2nd DUI or no more than 180 on a 3rd
- Their current case does not involve a firearm and/or deadly or dangerous weapon or use of force
- They are not already on an intensive supervision caseload
- They meet screening criteria through the program’s assessment tool
Collaborative Program
The Multiple DUI Court Program is a collaborative effort between the following partners:
- San Mateo County Superior Court
- District Attorney’s Office
- Private Defender Program
- Behavioral Health and Recovery Services
- Probation Department
